Calcutta High Court: “The State has committed a serious wrong which demands intervention.”
The Calcutta High Court has struck down the wrongful posting of Dr. Aniket Mahato, Dr. Asfakulla Naiya, and Dr. Debashish Halder.
Dr. Mahato was allotted RG Kar Medical College after counselling.
The State arbitrarily changed this to Raigunj Hospital, claiming it could “do whatever it wants.”
The Court has ordered the posting to be reversed and restored to RG Kar.
The State Government and its IT cell supporters tried to portray this issue as if city doctors were unwilling to serve in rural areas. Today’s judgment proves it was never about avoiding service—it was always a fight for justice. Their palace of lies now lies shattered.
In this struggle, different choices were made to expose the truth. Dr. Aniket did not join at Raigunj, enabling a direct legal challenge. Dr. Naiya and Dr. Halder, however, joined there in good faith to demonstrate to the people that there was no truth in the false propaganda being spread. As a result, Dr. Aniket’s judgment has been delivered first, while the cases of Dr. Naiya and Dr. Halder remain before the Court, with orders expected after Pujo.
This ruling sets a precedent: counselling cannot be nullified, SOPs must be followed, and junior doctors can seek justice if postings are manipulated.
