Hon’ble Chief Justice,
Today, we are compelled to submit this memorandum with deep anguish, sorrow, and concern.
Time and again, it has been proven that “Justice delayed is justice denied.” Millions across the country are losing faith in the principle that the law is equal for all. Ordinary citizens wait for years for justice, while the powerful and those close to the ruling party often evade punishment.
The rape and murder of a young doctor at R.G. Kar Medical College has shaken our society. The Chief Justice of India was appalled by the horrifying incident. The honourable judge of the Kolkata High Court compared the dreadful incident of 9 August 2024 with the devastating atomic bomb explosion in Nagasaki on 9 August 1945. Even after one year of the perpetration of the unprecedented cruelty, no supplementary chargesheet was issued.
After such a heinous crime, we had hoped the judiciary would take swift and firm action. Instead, we witnessed delays, inaction from investigative agencies, and reluctance from even the highest court to intervene decisively. This has led not only to grief but also to widespread outrage and despair. People are asking—if justice is denied even in such horrific cases, then for whom is the law ? What is the court for?
The absence of complete justice in this case has emboldened criminality. Across West Bengal—in places like Kultali, Jatragachhi, Jaigaon, Barrackpore, Canning, Haridevpur, Konnagar, Durgapur, Dattapukur, Sonarpur, Kaliganj—and beyond – in Noida (Haryana), Satara (Maharashtra), and countless other locations, grave incidents of violence against women, rape, and terror have occurred.
Hon’ble Chief Justice, if perpetrators begin to believe that with the blessings of ruling party leaders, the courts, police, and investigative agencies cannot touch them—then society will descend into further chaos. The foundations of democracy will crumble, the law will lose its sanctity, and citizens will be completely deprived of justice.
There is a growing fear of eroding public trust in the legal and judicial system. We do not wish to imagine such a dreadful future. Therefore, on behalf of the people, we make the following clear and urgent appeals:
1. Ensure a swift and impartial trial in the R.G. Kar case.
2. Safeguard the judiciary from any political influence or interference.
3. Take necessary steps to ensure that investigative agencies can function independently and constitutionally.
4. Actively uphold the constitutional principle that no one—be it a powerful individual, political leader, minister, or bureaucrat—is above the law. Reinforce public faith in the Indian Constitution by affirming the equality of law and declaring that no person—minister, leader, or influential figure—is beyond its reach.
With these expectations, we submit this appeal to you.
